i wanna ask if how true the issue that if u have a japanese passport u cannot buy a property to the philippines? even if im a filipina? please anyone knows about this issue pls. share ur opinions here.thank you...

I'll try to answer your question ha.

Sa tingin ko pwede pa rin pero may limitasyon di gaya ng kung Filipino citizen ka. So this presupposes that a change of passport signifies a change of citizenship (sana tama ako :D )

Mag dedepende sa purpose ng paggagamitan ng real property kung gano kalaki ang lupain na gusto mong bilin. Kung nasa urban area ka, up to 5 000 sq meters at 3 hectares naman kung ikaw ay nasa rural area. Isang special law ang basehan nito (RA 8179 sec 10). I quote ko ha:
Any natural-born citizen who has lost his Philippine citizenship
may acquire a private land up to a maximum area of five thousand 5 000 square meters in the case of urban land or three (3) hectares in the case c of rural land to be used by him/her for business or other purposes.
for business or other purposes. In the case of married couples, one
of them may avail of the privilege herein granted.

Oooopps, teka lang po. Parang may bigla akong naisip na tanong. Excuse me muna Rowena ha. Dont worry, about the limitation thing totoo naman yon and it applies to naturalized citizens. Pa OT lang sa thread mo sandali ah.

Naisip ko lang kasi, allowed sa constitution natin ang dual citizenship(sec. 4 Citizens of the Philippines who marry aliens shall retain their citizenship, unless by their act or omission they are deemed, under the law, to have renounced it. So yung mga nag-asawa ng Hapon, kahit alien ang asawa nila Pinay pa rin sila dahil yon sabi ng batas di ba. Ang naging tanong ko sa sarili ko bigla eh tngkl sa phrase unless by their act or omission they are deemed, under the law, to have renounced it. Dehins ko sure kung ang pagkuha ba ng Japanese passport ay considered as an act of renunciation.

Ang sure ako dahil sabi sa consti eh dual allegiance of citizens is inimical to the nat'l interest and shall be dealt with by law. Ang problema lang, vague kasi itong term na dual allegiance. So ang oath of allegiance ay kbilang dito? Di ba isa yon sa requirement para maging naturalized alien?

Na i bring up ko lang ksi naalala ko dati ang daming kaso involving citizenship na pumapabor sa non renunciation. Ang sabi kasi kailangan yung term na BY HIS ACT/OMISSION eh equivocal daw dapat at walang ibang tutumbukin kng hindi ang pag renounce sa FIlipino citizenship. Magulo ba, sensya na ha.

Kaya ito na lang pagkuha ng Japanese passport ang dapat i-clarify mo..Why not call the Phil.Embassy about it? Isang tawag lang at masasagot mo na ang tanong mo..

Kaya,even if you are a naturalized citizen of Japan,signified by you holding a Japanese passport,kung sakali,you can still retain your Philippine citizenship and acquire landholdings there like a natural citizen..

Anyway, you dont have to renounce your Phil citizenship I think when you take on a Japanese Citizenship..But if the Japanese laws require it,you have to denounce it temporarily,and then apply for re-acquisition if Phil citizenship as shown in the following page..

But first call the Phil.Embassy first for more detailed and accurate interpretation..Thay have more experience and have the legal capacity to enforce it anyway..But try to hold on to your
Phil passport if you can so when you come home,you have to show both passports at the Immigration.

Philippine law does not allow ownership of properties/land by foreigners. This has been a long winding concern not only among foreign residents but investors as well. While the Philippines' new Dual Citizenship Law provides avenues for naturalized former Filipino citizens to reaquire nationality, the Government of Japan does not promote it, in fact it is against the law to maintain allegiance to another country when you have reached the mandatory age of 21 (or was it 20?)

While there may be no visible way for the Japanese Government to check its peoples' loyalty, unless you flash your two passports at the immigration counters or somebody snitch on you, an adult dual passport holder may find himself in trouble once they find out. For naturalized citizens, this might result in the revocation of the citizenship.

If you want to buy a property in the Philippines you may want to consult a realtor or ask your relatives to make representations in your behalf. You finance the property, their name appear on all legal docs. You do not have a strong legal stance on ownership but what the heck - if you trust your relatives enough not to run away with the property, then its a convenient workaround. If not - then wait until the law on property ownership gets amended.
