hello tf sensya na ngayon lang ako nakapost ulit busy sa work eh.ask lang po ako about sa mondai ng friend ko dati siyang os 1yr ang spouse visa nya then may anak sya sa pinas sa dating asawa nyang pinoy ang kaso ang apelyedo ng bata ay apelyedo ng dati nyang asawa ano po ba dapat gaiwn para mainvite nya ang anak nya papunta dito sa japan?please advice me thank you po sa magreply !morepower sa po sa lahat.

If a foreign parent has a residence qualification as a Japanese spouse, you can get your son which is still at minor age to live here and acquire a residence visa for your son.

Also if consent and understanding from your Japanese husband is attainable, he can adopt your son and all the necessary papers and documents should only be submitted at the city hall for approval. However, if the approval from the family court in the Philippines or approval from the third party(example, the father of your son) is needed, there is a need to settle that also.

Approval from Family Court in the Phillipines is also necessary for adoption but in other case, you can also make your adoption thru the approval of Japan's Family Court. Approval from the Family Court of Japan is done because the Family Court here investigate whether the adoption is for the sake and for the good of the child and its almost the same with the procedure of the approval of adoption in the Philippines. That is why it is more convinient that adoption procedure is done here in Japan since the mother and the one who will adopt the child is living here.

Adoption procedure is easy to do, but the real problem is when the child came here in Japan and start to live here. Since the adoption was approved, your child will be treated by your Japanese husband like his real son as stated in the law.

Please note that with the consent of your husband, you can get approval from Family Court here in Japan to apply for a permanent visa for your son.
