Tanong ko lang kung sino may knowledge sa inyo nitong "huzyurimouside" kasi naalala ko to nang mag-seminar ako noon sa CFO bago ang unang lipad ko pa-Japan. Ito daw po ang papel na pwede pirmahan kung takot ang esposo ng Hapon na i-divorce sya. Kasi may friend ako sa Pinas asawa sya ng Japanese, sa tin sya nakatira since ikasal sila 10yrs ago. Pinapadalhan lang sila ng pang-gastos mag-ina at binibisita sila pero madalang. Ngayon pakiramdam ng friend ko nanlalamig na si lalaki kaya na-remind ako ng papel na to. Pwede ba ako kumuha nito sa City Hall kung san nakatira asawa nya, padala ko sa kanya para pirmahan at submit ko to prevent her husband na mag-file ng divorce:confused:

If you wanted to prevent your husband to file a divorce paper you can submit a "Fujuri Moushide" or refusal of the said divorce paper. You must submit it to the city hall where your husband live. Doing this will make your husband divorce application invalid within 6 months upon submission of the said documents.

Also, this application is also valid eventhough you have already signed the divorce papers provided that you submit it first before your husband submit the divorce papers at the city hall.

The validitiy of this document is only 6 months, but if you feel that there is a need to stop your husband annulment to you or you are not yet sure to yourself, you can submit a new one again.

kung lumipat ng ibang prefecture or region yung husband, tapos doon sa bagong lugar na tinitirhan mag file ng divorce (kahit saan cityhall ba pwedeng mag file?), valid or in effect pa rin ba yung "Fujuri Moushide"?

pag lumipat ka ng lugar na tirahan here sa japan, all japanese including foreigners are required to submit application of change of address. pag nagsubmit yong japanese, matitrace din sya kung saan sya nakatira and the Fujuri Moushide will be forward to the place(city hall) where he is living i think.

Oo nga, I think so, too.
Otherwise, everyone will move his address and then submit the divorce paper, thus disabling the Fujuri Moushide.

However, the Fujuri-moushide is named to the Mayor of the former city, not the current one.

Theoretically speaking, a contract is between two natural persons (meaning a Mayor in this case, not a city office, which is a legal person.) and without proper paper work, the persons in contract cannot be changed.

Maybe you will just be informed of his move and will be advised to re-submit the paper to the current Mayor.


There may be clerical errors.
Maybe they forget to notify you.
I think you have to confirm the new city as soon as you knew he changed the address.


But if they are away from each other for a long time, then if he files a lawsuit to the Family Court, seeking to get a grant of divorce against the will of the spouse, he may win the case, because the reality of marriage is already nonexistent, and there is “a grave reason which makes them difficult to continue the marriage.”
(As for this “long period of time”, some say more than 7 years, some say 3 years, but basically it is case by case. There is no particular period of time in law, if you know where he lives, how to contact him, etc.)
If he wins the case, needless to say, the court order is stronger than the Fujuri Moushide.

naging curious lang po ako.:type: Pwede po bang i divorce ka ng Japanese spouse mo even without your knowledge? Pwede po ba mangyari yon na wala kang ka alam-alam na idinidivorce kana pala? kahit wala kang pinirmahan na divorce paper(mutual divorce), posible po ba mangyari na maidivorce ka? curious lang po,pero wala po kaming balak na maghiwalay ng hubby ko. :king:

It is possible, it happens a lot.
But it is illegal, of course.
TF is not a place to discuss how to do illegal procedures, so I stop here.

But remember:
Max 2 years in prison. (公正証書不実記載罪 kose i shosho fujitsu kisai zai)
However, if the other party agrees with the pekeng papeles after that (追認 tsuinin) the indictment shall be dropped, making him/her innocent.




There is no guarantee the other party would do it, so don’t even think about it!
(I know you said "curious lang po", but the temptation of Satanas is very strong, be careful.)

ang alam ko mas malaki "say" ng Japanese sa divorce at may nabasa ako sa ibag reference na kung minsan na-fafake ang signature ng foreigner na spouse lalo kung hanko ang gagamitin. im aware of the mutual divorce at meron din naman nagkakabayaran pag nangaliwa ang isang party at nalaman to ng partner nya. sa case ng friend ko nasa Pinas sya at di inaasikaso ng hubby nya ang expired visa nya so parang wala syang laban kung may gawing magic asawa nya. by the way kaya nakatira for 10yrs friend ko sa tin kasi sabi ng hubby nya di raw sila kayang buhayin mag-ina dito sa Japan dahil maliit lang sweldo nito. i may be wrong with what I know, hope others can share their knowledge about this:)

Malamang nangyayari talaga to kasi kaya nga may ganitong klaseng papel is para i-prevent ang divorce, divorce na nai-fifile ng di sinasang-ayunan ng isang partido. Gusto ko sana malaman kung pwede ako ang kumuha ng papel na to sa City Hall para mapirmahan ng friend ko at submit ko na rin para sa kanya:confused:

YES! very possible yan,in fact i have a friend right now na undergoing ang case with the said situation.Umuwi sya ng pinas for a month lang yata,may babae pala ang asawa nya,finorge ang sign nya para makapag divorce,sanay mag forge kasi promoter.Ayun,wlang kamalay malay yun fiend ko pag balik nya na divorce na pala sila,narinig nya na lang sa iba na nagpakasal daw yun asawa nya sa pinas(kapal noh).And she filed a case against it.And regarding that,big possibility na mananalo sya sa case nya.:mad: Un lang po,naishare ko lang.
